1. Agreement to Terms

By accessing or using WarmPage ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

WarmPage is a SaaS platform that enables businesses to personalize landing pages for cold email campaigns. The Service includes:

• Creation and management of personalization campaigns
• A JavaScript snippet for your website
• Magic link generation for email campaigns
• Analytics and visitor tracking

3. Account Registration

To use the Service, you must:

• Create an account with accurate information
• Be at least 18 years old or have legal capacity to enter contracts
• Keep your login credentials secure
• Notify us immediately of any unauthorized access

You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these terms.

4. Free Trial

New users receive a 14-day free trial with access to all Pro features. No credit card is required to start the trial. After the trial period, you must subscribe to a paid plan to continue using the Service.

5. Subscription Plans and Pricing

We offer the following subscription plans (prices exclude VAT where applicable):

Prices may change with 30 days notice. VAT will be added for EU customers based on your location.

6. Payment Terms

• Subscriptions are billed monthly in advance
• Payments are processed securely by Polar
• You authorize us to charge your payment method on file
• Failed payments may result in service suspension

7. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period.

Refund Policy: As a B2B service, we do not offer automatic refunds. However, if you are unsatisfied within the first 14 days of a paid subscription, contact us to discuss your situation.

8. Acceptable Use

You agree NOT to use the Service to:

• Send spam or unsolicited communications
• Violate any applicable laws or regulations (including GDPR, CAN-SPAM)
• Infringe on intellectual property rights
• Transmit malware or malicious code
• Attempt to gain unauthorized access to our systems
• Engage in deceptive or fraudulent practices
• Use the Service for illegal purposes

Violation of these terms may result in immediate account termination without refund.

9. Your Content

You retain ownership of content you create using the Service (personalization rules, campaign configurations, etc.). By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

You are responsible for ensuring your content complies with applicable laws and does not infringe third-party rights.

10. Intellectual Property

WarmPage, its logo, and all associated intellectual property are owned by Leonardo Christino. You may not copy, modify, or distribute our software, branding, or proprietary technology without written permission.

11. Third-Party Integrations

The Service integrates with third-party platforms (Framer, Webflow, email tools, etc.). We are not responsible for the availability, functionality, or terms of these services. Your use of third-party integrations is subject to their respective terms.

12. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice when possible. We are not liable for downtime, data loss, or service interruptions.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months

This limitation does not apply to liability that cannot be excluded under Dutch law.

14. Indemnification

You agree to indemnify and hold harmless Leonardo Christino from claims arising from your use of the Service, violation of these terms, or infringement of third-party rights.

15. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or through the Service with at least 30 days notice. Continued use after changes constitutes acceptance.

16. Termination

Either party may terminate this agreement at any time. Upon termination:

• Your access to the Service will cease
• You may export your data before termination
• We will delete your data in accordance with our Privacy Policy

17. Governing Law and Disputes

These terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in the Netherlands.

18. Severability

If any provision of these terms is found unenforceable, the remaining provisions will continue in effect.
